Is it riba?

Is rent-to-own halal?

A real lease has an owner who keeps ownership and its risks while you pay for living there. Ownership can pass to you at the end by a separate sale or gift, as promised. What is not allowed is one contract that is a lease and a sale at once, where it is unclear what each payment buys and you may lose everything on default.

Who pays for repairs and insurance in a halal rent-to-own?

Major repairs and insurance fall on the owner, because the owner bears the risk of the asset. You pay for day-to-day upkeep as a tenant would.

Can the final purchase price be fixed in advance?

Yes. The price in the promise may be fixed, set at market value, or agreed at the time. The promise must be separate from the lease.

Is a non-refundable option fee halal?

A deposit that counts toward the price and is refunded if there is no sale is fine. The Hanafi school does not allow a payment that is simply lost if you walk away; the Hanbali school, the OIC Fiqh Academy and AAOIFI allow a forfeitable deposit within a fixed time limit.
